About ADR Conflict Resolution
Alternative Dispute Resolution (ADR) is term used to describe out of court legal settlements reached through mediation, conciliation and arbitration. ADR is faster, less formal, cheaper and often less adversarial than a court trial. ADR is sanctioned by the United States, European Union and countries throughout the world as a standard legal procedure. ADR helps relieve the long delays in today's overburdened court system.
The National ADR Board combines the best practices of mediation, conciliation and arbitration. The Board adheres to the fundamental rights that businesses and individuals are capable to resolve their own disputes, disagreements, conflicts and issues when provided with helpful support and insight. The National ADR Board provides a legal alternative to the high cost of court litigation.
The National ADR Board uses a non-adversarial approach. It ensures disputants the freedom of choice to create legal structured settlements without the burden or influence of political, public and governmental pressures. Unlike civil and common law courts whose decisions are determined by a judge or jury, the National ADR Board structured settlements are decided by mutual agreement through formal discussions facilitated by a skilled neutral mediator.
The mediator does not issue a decision nor does the mediator decide who is right or wrong; or what is fair based on previous law cases. The mediator actively participates with the disputants and to ensure open communication about each disputant's position. The mediator helps disputants form a structured settlement to satisfy their interests. The items agreed upon are transcribed into a legal document. Settlements can be structured in whatever method necessary and do not have to conform to legal English, case law precedents or provisions of codes and statutes.
